Experience Over thirty years experience in general civil litigation in state and federal trial and appellate courts, including environmental
matters, disputes over real property rights, eminent domain cases, commercial litigation, employment rights litigation involving age, race, sex, sexual harassment, and First and Fourteenth Amendment issues, tort claims, personal injury claims, probate and suits for judicial review of administrative decisions. Transactional experience in real estate leasing and sales, contracts for
consulting and professional services, commercial agreements, construction contracts and corporate governance and ownership.
Over thirty years experience as lead counsel in real estate and environmental litigation and permit hearings including
the following:
Permit hearings within the current jurisdiction of the Texas Commission on Environmental Quality and its predecessors [the TNRCC, the Texas Water Commission, the Texas Air Control Board and the Texas Department of Health] concerning such activities as hazardous waste incineration, medical waste incineration, wastewater treatment and Type I and Type IV
landfills;
Actions for injunctive relief under clean air, water, and solid waste disposal statutes involving such facilities as chemical processing plants, medical waste incinerators, Type I and Type IV landfills, and wastewater treatment plants;
Actions involving claims for civil liability for personal injuries due to environmental exposures and actions for damages to real property caused by water and air pollution;
Eminent Domain cases and actions based on drainage diversion including claims against governmental entities.
Supervisory attorney in environmental litigation for seven years. Supervisory attorney for eminent domain litigation with responsibility for all aspects of eminent domain procedures including pre-litigation legal guidance and trial and appellate proceedings. Responsibilities included condemnation of right of way for the Hardy Toll road.
